PUBLICADO REGLAMENTO PARA LA APLICACION DE LA LEY DE REGIMEN TRIBUTARIO INTERNO

El Decreto 374, que contiene el Nuevo Reglamento para la Aplicación de la Ley de Régimen Tributario Interno fue publicado el día martes 8 de junio en el Suplemento del Registro Oficial No. 209, mismo que lo tendremos disponible en nuestra sección Biblioteca Virtual.

EL INCREMENTO EN EL PORCENTAJE DE RETENCION OCACCIONA REACIONES ENTRE LOS PROFESIONALES


Como es de conocimiento público a partir de hoy rige el incremento del 8% al 10% de la retención en la fuente del Impuesto a la Renta para los profesionales como médicos, abogados, periodistas y otros que no guardan relación de dependencia laboral, siempre y cuando los servicios que estos presten estén relacionados con su título profesional.

Sin embargo la medida ha generado el rechazo de varios especialistas, por considerar que es un perjuicio para ellos y, por tanto, aseguran que trasladarán esos dos puntos porcentuales al cliente al que ofrecen sus servicios.

Los profesionales sin relación de dependencia cobran por sus servicios a través de la factura. A quienes ejercen una actividad acorde  a su título profesional, el cliente les retiene el  IVA (Impuesto al Valor Agregado) y desde hoy el 10% del IR. Esta retención es un anticipo de impuestos que posteriormente puede ser devuelta al contribuyente.

INTERES RATE ON TAX ARREARS
SUBJECT: Interest rate on tax arrears

According with the provisions of article 21 of the Tax Code and article 1 of the Tax Equity Law, which provides that the annual interest rate for non-satisfied tax liabilities will be equivalent to 1.5 times the benchmark lending rate for ninety days determined by the Central Bank of Ecuador. The monthly interest rate for tax arrears applicable to the period from April to June 2010 is as follows:

Term: 01 April 2010 - June 30, 2010
Rate: 1.151%

TAX COLLECTION INCREASES IN 2,200 MILLION  

The head of the Internal Revenue Service (IRS) Carlos Marx Carrasco announced "that the payment of taxes from citizens is gradually getting better." According to him, “the tax collection of $ 4,500 million increased to $ 6,700. Also the Income Tax and direct taxes participation increased from 31% to 42%. "

He added "that there has been no tax raise in the country ", the opposite has happened according to Carrasco "some (taxes) have been removed. The final sum decreased in $ 574 million, partly due to the elimination of Special Consumption Tax (ICE) to telecommunications. Only that tax in 2009 could have generated $ 400 million. "

Carrasco said that "the impact of the Tax Reform applied in 2009 translates into the transformation of the minimum Tax, the dividends being taxes and the lifting of bank secrecy for tax purposes."

ADVANCED INCOME TAX PAYMENT FOR YEAR 2010

Resolution No. NAC-DGECCG10-00007 explains the way to declare the payment in advance of the Income Tax for year 2010.

Regarding the declaration it states that:

“The advanced payment calculated subject to what provision 41.2.b of the Internal Tax Regime Law states shall be specified in box 879 “Advance for Next Year” of the Income Tax form regarding 2009.  It should be noted that for this calculation the value of the legal deductions are not to be considered. "

Regarding the payment in advance it states that:

"According to what provision 41.2.c of the Internal Tax Regime Law states that before payment you should subtract what was calculated by the deductions that have been practiced to the taxpayer in the previous year.  The result will be paid in two equal installments in the months of September and July 2010.
The balance of the advance payment (what was calculated subtracted by the amount actually paid) will be paid along with the declaration of Income Tax for the year 2010 -to be filed in March and April 2011 using the boxes that will be provided in a timely manner. "

THE CONTRIBUTORS´ CHECKING ACCOUNTS ARE BEING MONITORED BY THE IRS

The control over assets have increased from January 1st 2010. The monitoring of the Wealth statement will be greater.

The total of wealth statements received in 2009 was 29,269.  Slightly over 50% of the total of statements were of the Northern Regional, while 18% were from the South Coast so the Director of the Internal Revenue Service expressed “I don’t think there are more people with economic power in Quito than in Guayaquil. With the mechanisms that we put in place since January this year, we tend to close that gap. "

One of those mechanisms is the power of the IRS to have access to movements in citizens´ bank accounts. Since the adoption of amendments to the Tax Equity Law, adopted on  December 23rd there is no banking secrecy. "We guarantee confidentiality. CREDIT NOTES PDF Print E-mail

DEMATERIALIZATION OF CREDIT NOTES

Beginning February 23rd the IRS will apply the dematerialization of Credit Notes issued by Tax Returns; thus removing from the market the physical document previously issued by the Internal Revenue Service, therefore the taxpayers should exchange the Physical Notes  for the dematerialized Notes in the IRS until May of the current year.

ADVANCE PAYMENT METHOD PDF Print E-mail

THE INCOME TAX ADVANCE PAYMENT METHOD HAS BEEN AMMENDED

The method for calculating the Income Tax advance payment for companies, and for individuals and undivided estates that are required to keep records has been amended.  This is to be determined solely by the application of a formula that adds 0.2% of total property; 0.2% of total allowable expenses; 0.4% of total assessed income, and 0.4% of total assets.

LAW AMENDING THE INTERNAL TAX REGIME LAW AND THE AMENDING LAW FOR THE TAX EQUITY IN ECUADOR

Today has been published in the Supplement of the Official Gazette No. 94 a “Law Amending the Internal Tax Regime Law and the Amending Law for the Tax Equity In Ecuador,” its most important modifications are:


• An increase from 1% to 2% to the Foreign Exchange Outflow Tax.
• New method of calculation for the payment of the Income Tax advance.
• Commercial gains and dividends are considered as Ecuadorian income.
• Sales Tax is levied on newspapers and magazines.
• New conditions for export of services.
• Changes related to Transfer Pricing.
• New goods are levied with Special Consumption Tax.
